how to install yum in RH enterprise ??

Yes, it is EL3 But I downloaded the 4 packages and I
still faced the same problem as below.  

Do u know why?  Beside may I know whether I can use
yum to replace up2date to update the EL system without
paying the RHN Fees that required by up2date?  

Now, the subcription has expired, so if yum is
installed in EL, I can just use "yum update all" as in
FC to update the EL system right ?  Then why need to
pay the RHN fees for EL?   Why yum is installed in FC
but not in EL ?
